7:00 p.m. Monday, December 10, 2012

Call Meeting to Order: Mayor Lennie Smith called the meeting to order at 7:00 p.m.
Roll Call: Robin Elliott, Roger Fisher, and Ted Schultz were present. Absent: Barb Arthur and Garrett Roche. Also present: Larry Crady, Duane Venenga, and Christina Machin.
Inquiries from the Community: Crady commented on a situation currently affecting the Council. He asked the Council to enforce Iowa Code 66.1A and 66.29 which both relate to the removal of an elective officer “for willful or habitual neglect or refusal to perform the duties of the office.” The city clerk will contact the city attorney to discuss.
Approval of Minutes: Fisher moved to approve the minutes of the November 12, 2012 meeting as submitted. Schultz seconded. Ayes: All.
Treasurer’s Report: Schultz moved to approve the November treasurer’s report as submitted. Fisher seconded. Ayes: All.

Mayor’s Opening Address and Report
Mayor Lennie Smith was contacted by the Oakland Acres Golf Club telling him that the City could hold their Christmas party at the clubhouse and they did. Oakland Acres Golf Club also mentioned that they are now taking memberships. An application can be obtained on their website at www.oaklandacresgolfclub.com. If paid before 2/15/13, 10% may be taken off of the price of the membership.
Smith reported that Oakland Acres is now on Facebook.
Old Business
Planning and Zoning Report: Crady presented the Planning and Zoning Commission’s recommendations on items referred to them by the Council at the November meeting.
The first issue dealt with the eastern 20’ x 85’ section of Duane Venenga’s property. The Planning & Zoning Commission found that the City owns a portion of that parcel, but the property has been maintained by the Venenga’s. Fisher moved and was seconded by Schultz to vacate all of the City’s interests in Parcel C in the 6th subdivision. Ayes: All. A resolution will be passed at January’s meeting pending a public hearing.
The second issue dealt with the ownership of Parkview Drive and a portion of Fore Seasons Drive. Fisher moved to accept Oak Helm Partners proposal for the City to pay $941.25. This would include the cost of them preparing the paperwork to get title transferred to the City. Schultz seconded. Ayes: All.
One other issue discussed by the Planning and Zoning Commission was in regards to an easement around Oak Lake. There is a 10 feet easement around the entire lake and that the lake is indeed owned by the City. There is also a perpetual easement around Oak Lake for Oakland Acres Golf Club for lots 1, 2 &3.
Lawyer Evaluation: Schultz reported that he had contacted the Jasper County attorney, Poweshiek County attorney, and Mike Mahaffey for their recommendations for a city attorney. The Council discussed that they would like 3 names for a possible city attorney. Discussion was tabled until next month in order to obtain more recommendations.
Directory Update: Council submitted information to Smith for updates to the directory. He asked the remainder to be e-mailed or dropped off to him in order to get the new directories printed in January.
Holiday Party and Luminaries: Smith reported that 41 people attended the Holiday Party. Everyone seemed to have a really good time. There were a lot of kids in attendance which was great to see. Pictures have been posted on Facebook.
The annual luminary display will be next weekend on Saturday, December 15th. Smith would appreciate all the help he can get. Residents can meet at the maintenance shed at 10:00 a.m. that day to cut jugs, load them with sand, and load up the trailer. Please bring a utility or box knife if planning on helping cut the jugs. He would also like to have help at 4:00 p.m. to light them. He asks that residents who have luminaries in front of their house to please light them. Sunday morning the luminaries will need to be picked up and he welcomes help in doing that also.
Safety Reminder: Please slow down and use caution during the time of the luminary display.
Ordinances and Incidents: Discussion was tabled.
New Business
Plans for 2013: Smith discussed the following plans for 2013: finish cleaning up dam, more trimming around the park as well as another dead tree, put up new basketball net, get people to research bond issues for money for roads, Easter Egg hunt, electricity for the park, and replace the posts along the dam.
Park Committee Proposal: Smith gave out copies of a park committee proposal. It will be discussed at the next meeting after everyone has had a chance to review it.
Other New Business: There was none.
Council Report:
Transportation: There was none.
Community: Elliott spoke with different families who have shown an interest in community events. It was recommended that a parent committee be developed to help plan parties. Some parents Elliott spoke with suggested having a pot that residents could donate to to help fund different functions. Anyone interested in being part of a committee, please contact Robin Elliott at 641-990-6438 or e-mail her at robin.isu97@gmail.com. She wants people to know that she usually checks her e-mail just once a week. The Council also discussed that a Welcoming Committee could be part of this group as well.

Clerk Report: There was none.
Maintenance Report: Smith reported that the mower is off and the blade is on the tractor.

The next regular meeting of the Oakland Acres City Council is scheduled on Monday, January 14, 2013 at 7:00 p.m. at the Oakland Acres Maintenance Building.
