7:00 p.m. Monday, September 12, 2011
Oakland Acres Maintenance Building
Call Meeting to Order: Mayor Lennie Smith called the meeting to order at 7:00 p.m.
Roll Call: Robin Elliott, Roger Fisher, Nancy Minner, Michael Osten, and Ted Schultz were present. Also present: Christina Machin and Duane Venenga.
Inquiries from the Community: Smith reported that he had communicated with a resident of Oakland Acres East regarding the end of the road breaking up. Smith’s recommendation is to blow out the cracks and put a seal coat in there. The cost of doing this would be approximately $100. Unfortunately, there are several other areas that need to be fixed including the estimate presented by Chuck Griffith at the August 8, 2011 meeting to replace a section of Fore Seasons Drive. The budget will need to be reviewed for a timeline of when these areas can be fixed as well as options for repair. However, at this time it is the Council’s intention for this area to be repaired with concrete with no curbs. They will not be doing oil and gravel.
Smith discussed a dog barking issue with a resident. The resident attributed the excessive barking to the dog trying to get settled in and use to its new surroundings including the wildlife. The resident asked Smith to wait one week to see if the dog settles down; and if not, he will get a bark collar.
Please remember that trees need to be trimmed that are hanging over the road. Smith asked the Council to drive around and remind people of this. The Council discussed having a date where residents can bring tree trimmings to a specific spot for burning. They decided the dates for this would be Saturday, October 8th and Saturday, October 15th from 8 a.m. to noon. Please bring tree trimmings only (no grass, no garbage, no processed wood) to Oak Lake Dam. A Council member will be present at this time to answer questions.
Approval of Minutes: Osten moved to approve the minutes of the August 8, 2011 meeting as submitted. Schultz seconded. Ayes: All. Schultz moved to approve the minutes of the August 22, 2011 special meeting as submitted. Osten seconded. Ayes: All.

Payment of Bills: Discussion: Council discussed who should be legally responsible for paying to improve the park. Minner will follow up with the city attorney. Osten moved to approve payment of the bills as amended. Schultz seconded. Ayes: All.

Mayor’s Opening Address and Report
Mayor Lennie Smith did not have any additional report that wasn’t already covered in Inquiries from the Community. He did add that if residents are having issues with neighbors, to first talk to your neighbors; and if the problem does not get resolved, then bring it to the Council.
Old Business
CIWA Update: Smith missed the Department of Health meeting on the 19th. He had been told it was on the 26th. At the meeting, CIWA brought a letter that they had drafted and wanted the Department of Health to send out to all Oakland Acres residents that they had to hook up to their sewer no matter what at the time of transfer of property. The Department of Health told them not to send the letter. They are now taking it to the Jasper County attorney to see what legal options there are as well as discussing it with CIWA’s attorney and Oakland Acres’ attorney. The next meeting is September 22, 2011. However, Smith will be attending the Iowa League of Cities Conference and will be unable to attend the meeting.
Telephone Contract Information: Minner talked to the city attorney and he advised her that since the franchise is expired for telephone services, that the city can bid it out. Osten drafted a letter to Windstream informing them of this. The Council recommended that he mail the letter.
Ordinances: City clerk received a letter from Iowa Codification regarding setting fines for parking violations in Section 70.03. Elliott moved and was seconded by Schultz to amend the ordinance to set the fine at $25.00. Ayes: All.
Legal Information: The city attorney recommended sending two letters of warning before addressing ordinance violations with legal action.
Reminder to all residents: Please keep yards mowed and grass clippings off of the road.
New Business
Ambulance Service Contract Information: Smith reported that the City of Grinnell is looking at options for the current franchise agreement they have with Midwest Ambulance. They are holding a series of meetings to look at their options which include keeping the current ambulance service, choosing another ambulance service, or using the hospital. Smith will send out an e-mail to the Council with the schedule of upcoming meetings. The Council will need to decide if they want to stay with Grinnell and whatever they decide or discuss other options.
Lake and Maintenance Estimates: Smith reported that he has spoken to two individuals about dredging the lake. The second individual said he charges $200 per hour. The last lake he did about the same size as the City’s cost $40,000. Smith does have a call into another individual, but he has not returned his call yet.
Smith reported that it will cost around $100 to fix the maintenance overhead door.
Resolution to Approve and Adopt the FY 2011 Street Financial Report: The Council unanimously passed Resolution # 2011-06 to approve and adopt the FY 2011 Street Financial Report.

Community: Elliott thanked Venenga for all of his work to the park and making it look so nice.
Treasurer: There was none.
Maintenance: There was none.
Interest and Events: There was none.
Smith asked the Council to get out and meet the new residents in the community.
Clerk Report: There was none.
Maintenance Report: Smith reported that the brush piles at the city park have been burnt. He continues to receive a lot of positive comments on the park. The nets were put up on the basketball hoops. The door on the maintenance shed will get fixed.

The next regular meeting of the Oakland Acres City Council is scheduled on Monday, October 10, 2011 at 7:00 p.m. at the Oakland Acres Maintenance Building.
